THAILAND AIR OPERATOR CERTIFICATION

I. Initial Application for AOC
|
Granting of an AOC is a complex process, the application must be made at least 90 days before the anticipated start of operations. The processing time is dependent on your ability to comply with our regulatory requirements, which include:
|
Demonstration of an appropriate organizational structure;
|
|
Method of operational control;
|
|
Supervision of flight operations;
|
|
Training programme; and
|
|
Maintenance arrangements.
|

II. AOC Ownership
|
An applicant for Thai AOC must have their principal place of business in the Kingdom of Thailand and operate HS-registered aircraft, will certain exceptions.
A post holder in an AOC may not hold a post in another AOC without the approval of the CAAT. An AOC is not a saleable commodity and cannot be transferred from one legal entity to another. The fee paid for one AOC application cannot be transferred to another, even in the event of the first application being withdrawn.
In the event that a company is sold as going concern, it will remain the same legal entity and the AOC will continue to be in force provided that the management is considered competent. A new company established for the purpose of purchasing the aircraft etc. from an AOC holder is a new legal entity and must apply for a new AOC prior to the commencement of commercial operations.

III. Process of Initial Issue of an Air Operator Certificate (AOC)
|
The AOC issuance process shall be complied in accordance with the 5 phases of the CAAT Certification process which are;:
Phase 1: Pre-Application Phase
Phase 2: Formal Application Phase
Phase 3: Document Evaluation Phase
Phase 4: Demonstration and Inspection Phase
Phase 5: Certification Phase
1) Phase 1 Pre-Application Phase

A prospective applicant who intends to apply for an AOC shall enter into preliminary discussion with CAAT and will be provide with complete information that includes the following documents;

An intention letter to apply for an AOC

Application for Air Operator Certificate (CAAT-OPS-AOCFM-101)
-
Application for Operations Specification (CAAT-OPS-AOCFM-102)
-
Business Operations Plan
-
Financial Economic and Legal Matters Assessment
-
An Air Operating License (AOL) if applicable
-
The applicant shall submit above documents through EMPIC for applying Air Operator Certificate by CAAT.
-
A preliminary discussion is held whereby basic information and general certification requirements are discussed, and an application form is provided when the applicant desires to continue with the AOC application.

The applicants’ key management and staff will meet with CAAT to discuss and there will be an opportunity for you to ask questions about the application process.

CAAT will advise the prospective applicant on the approximately timeframe which consume during the certification process, subsequent to the receipt of a complete and properly executed application.

In this phase will also include a parallel assessment of the financial, economic and legal status of the applicant and the proposed operations.

The Applicant should prepare to discuss and demonstrate that you have considered:

The organisation of the company
-
Where your operation will be based and the location of your principal place of business
-
The Intended AOC management structure
-
The competence of the individuals who will be working for the operation
-
How the AOC will be financed
-
What sort of operation you require
-
What aircraft you intend to operate
-
What is area you intend to operate in
-
Your understanding of the regulations and requirements
-
Transportation of Dangerous Goods
-
If the phase meeting is satisfactory and both parties are in agreement that the application may proceed to the formal application phase.
2) Phase 2 Formal Application Phase

It is required that the formal application be submitted at least 90 days before revenue operations are expected to begin.

Assessment of the application package will only commence when CAAT has received the application payment and completed application package with contains the required information and attachments.

If the application package is not correct or is insufficient, all or part of the package will be returned to you for correction or completion. Failure to provide any supporting documentation within reasonable timeframes may result in the application for being stop certification process, and the applicant is required to start at the Pre-Application Phase again.

Application for Nomination for Air Operator Personnel Form (CAAT-OPS-AOCFM-106)

Management Team Biographical Data
-
Application for Schedule of Events (CAAT-OPS-AOCFM-107)
-
Statement of Compliance Chapter 1 to 14 (CAAT-OPS-SOC-101 to CAAT-OPS-SOC-114)
-
The application package for Dangerous Goods (if applicable)

Manuals and/or Information as described in the Regulation of Civil Aviation Board Number 85 Air Operator Certificate article 3 (15) as the following;

3) Phase 3 Document Evaluation Phase
|
A thorough evaluation of all the manuals, documents, and attachments etc. This is to ensure that all documentation meets the required standards and requirements. All manuals and documents submitted will also be retrained by the authority during the currency of an AOC.
4) Phase 4 Demonstration and Inspection Phase

Demonstrate to CAAT your ability to comply with regulations and safe operating practices.

Demonstrate to CAAT that your operator has an organisation structure, method of control and supervision of flights, training, ground handling and maintenance through proving flights and evaluation of respective organisations.
5) Phase 5 Certification Phase

Phase 5 Certification Phase

After all the demonstrations and evaluations including the review of documentation, have been completed satisfactorily, you will be awarded with the Air Operator Certificate (AOC) and its applicable Operations Specifications (OPS SPEC).

The Air Operator Certificate/Operations Specifications is valid for TWO YEARS from the date of issue or as prescribed in the Air Operator Certificate / Operations Specifications.

The total of duration is not less than 160 days depending on the applicant's ability to fulfil the required standards.
