Special Flight Permit
|
if it is necessary for any aircraft prohibited from flying under Section 41/89 of the Air Navigation Act B.E. 2497 no person shall fly an aircraft in the following cases: |
1. There is no Certificate of Airworthiness under Section 41/61 | |
2. A Certificate of Airworthiness becomes invalid under Section 41/70 | |
3. A Certificate of Airworthiness becomes temporarily ineffective under Section 41/85 | |
4. The Aircraft is not inspected pursuant to particulars upon expiration of the period of time specified in the order/directive by the Competent Official or Director General under Section 41/81 or Section 41/82 | |
5. The Aircraft is prohibited from flying pursuant to the order under Section 41/83 | |
6. A Certificate of Airworthiness is suspended under Section 41/86 | |
7. A Certificate of Airworthiness is revoked under Section 41/87 | |
to fly back to the base of the Aircraft registrant or Air Operator, to fly to a repair station or to fly for avoidance of impending danger or if it is necessary to allow any Aircraft having a Certificate of Airworthiness to make a flight apart from the limitations specified in the Aircraft manual, the Director-General of Civil Aviation Authority of Thailand may upon finding that such Aircraft is capable of safe flight for that purpose, permit in writing that the Aircraft fly to that place, subject to the conditions specified by the Director-General of Civil Aviation Authority of Thailand In accordance with Air Navigation Act B.E. 2497 section 41/90. or the aircraft necessary to conduct a Flight-testing under section 16 paragraph 2 (1) of the Air Navigation Act B.E. 2497 in the following purpose |

1. Flight-testing in order to use in the consideration of issuing Certificate of Airworthiness. | |
2. Flight-testing after aircraft maintenance in the event that the aircraft does not have Airworthiness certificate. | |
3. Flight-testing for other purposes, such as to demonstrate performance and deliver the seller's aircraft to the buyer or fly for aircraft research and development Or Fly to certify significant aircraft modifications etc.

Any aircraft registrant wishing to request permission to Flight test shall be submitted a request the Director-General of Civil Aviation Authority of Thailand in accordance with Announcement of the Department of Air Transport relating to Requirements for Flight-testing B.E. 2551
Special flight permits including Flight test may be issued to aircraft that do not meet the CAAT certification standards but is capable of safe flight. Special flight permit including Flight test shall be approved by the Director-General of Civil Aviation Authority of Thailand before flying and does not authorize flight over a country other than Thailand without permission of destination country. |

How long it is Valid?
|
For A Special Flight Permit the validity period shall be determined by CAAT and the consideration is based on conditions or requirements from TC holders. For Flight-testing it shall be valid for fourteen (14) days after the date of approval. |

4. | Documents and evidence showing authorization from the owner or person with possessory rights the aircraft shall be the applicant for the permission to conduct an aircraft flight test in the event that the owner or person possessing the aircraft and the applicant is not the same person |
5. | The applicants shall be provided aircraft insurance for damage caused to life, health and property of third parties. |

There process consists of 3 phases |

1) Application phase

1.1) |
Submit the request together with the supporting documents to The Civil Aviation Authority of Thailand (CAAT) 333/105 Lak Si Plaza, Khampheng Phet 6 Rd., Talat Bang Khen, Lak Si, Bangkok 10210
The assigned CAAT inspector will consider checking the documents and record in the system to be able to track the document later. |
1.2) |
Submit the request together with the supporting documents via EMPIC: https://www.caat.or.th/th/archives/55072
The assigned CAAT inspector will consider checking the document through the system. The applicant can be tracked manually through the EMPIC. |
1.3) |
After the assigned CAAT inspector have received the documents. The assigned CAAT inspector will proceed to check the completeness of document. If the request is completely correct or in the case that the request is found incomplete the assigned CAAT inspector will notify the applicant to send additional documents. In which the assigned CAAT inspector will notify the applicant within 10 working days and will take further steps if the applicant has already submitted additional documents (if any). If the applicant does not send the additional documents correctly and completely. The assigned CAAT inspector may consider returning the request to the applicant

For the applicant who submit the request via EMPIC. After the assigned CAAT inspector received the documents, the assigned CAAT inspector will contact the applicant through the system within a period not exceeding 10 working days if the document is completely correct the assign CAAT inspector will take further steps. In the case that the request is incorrect or incomplete the assigned CAAT inspector will notify the applicant to send additional documents or may reject the request and specify the reason in the system

2) Inspection phase

2.1) |
After the assigned CAAT inspector finishes reviewing the package

After the inspection date is set, the Inspection fee Invoice will be sent to the applicant via email within a period not exceeding 5 working days, in which the applicant must proceed to pay and notify the assigned CAAT inspector with evidence as a receipt via email or other channels.

2.3) |
At the inspection day, the assigned CAAT inspector will take time to proceed the inspection approximately not more than 6 working days (excluding travel days) as detailed in estimate the duration and number of CAAT inspector to be used for inspection in the annex of CAAT announcement relating to the administrative fee B.E. 2561 under Section 5/1 of the Air Navigation Act of 2497 B.E. 2560, which will be divided the inspections is a document inspection and aircraft inspection. When the inspection is complete, the assigned CAAT inspector will summarize the inspection results on the last day of the inspection.

2.4) |
If there is any finding(s), the assigned CAAT inspector will notify the applicant through the final inspection report on the last day of inspection, which the applicant should proceed to correct those findings within a period not exceeding 60 days and report the results of the findings correction together with the evidence documents through the electronic system of the Civil Aviation Authority of Thailand. If the applicant is unable to use electronic system of the Civil Aviation Authority of Thailand, the applicant can use other channels, such as email, to report the results of the findings correction.

3) Certification phase

3.1) |
After the assigned CAAT inspector reviewing the documents and evidence of the corrective action of the applicant (if any), the assigned CAAT inspector will notify the applicant and will proceed to request the approval from the Director of Civil Aviation Authority of Thailand to sign and issue a special flight permit within a period not exceeding 10 working days, the assigned CAAT inspector will notify the result of the consideration and make an appointment via email or other channels to deliver the special flight permit to the applicant.
